These terms and conditions (“Terms”) govern the use and access of our website and services at “carousify.com.” By accessing our website and its services, you agree to be bound by these Terms. These Terms also include our privacy policy (accessible at https://carousify.com/privacy/), as well as any guidelines, additional terms, policies, or disclaimers made available or issued by us from time to time.

If you don’t agree with any part of these Terms, we advise you not to use our website.

1. Acceptance of Terms

By accessing our website and using any services, you acknowledge that you have correctly read, understood, and agree to comply with these Terms.

2. Services Provided

Carousify.com offers various services and growth marketing tools that allow users to grow on social media platforms like LinkedIn, Instagram, and more.

Some of these services can include:

• Post Scheduling

…and other growth marketing tools that help people grow their social media pages/profiles.

These services further help those who register on our Platform (“Customers”) perform various actions related to growing their social media accounts.

3. User Responsibilities

As a Customer of Carousify, you must agree to terms, including but not limited to:

• Keep accurate and truthful information when creating an account on our website.
• AI can make mistakes, so make sure the information is accurate while publishing any post/carousel/comment through our platform.
• If you come across any bug or exploit in our system, make sure to report it instead of using it for personal gain.
• Always make sure to use 2FA for added security, and immediately notify us of any unauthorized use.
• Not to use our Services in any illegal manner to deliver hateful speech, spam, phishing, NSFW posts, or any type of content that can be harmful to others.
• Use our service in compliance with any or all applicable laws and regulations.

4. Prohibited Activities

You can only use our Carousify services for lawful purposes and in accordance with our Terms. You may agree not to use our Services for any unlawful or prohibited activities, including but not limited to:

• In a manner that violates any national or international laws and regulations.
• For the purpose of exploiting, harming, or attempting to exploit or harm minors or anyone else by exposing them to inappropriate content or otherwise.
• For the purpose of transmitting, distributing, or storing any content that is defamatory, obscene, abusive, or otherwise objectionable.
• To impersonate or attempt to impersonate a company, a company employee, or any other person. This also includes the creation or use of fake profiles and misrepresentation of your identity; impersonation of others is strictly prohibited.
• In any way that infringes the rights of others or in any way that is illegal, threatening, fraudulent, or harmful.
• Also, in a way that infringes the terms of the social media platforms with which we offer integration in our services.

5. Refund Policy

All Services and plans purchased from Carousify come with a 14-day, no-questions-asked refund period. After 14 days of making your first payment, we cannot provide a refund to our Services.

Users will also be notified 7-days before the renewal of their subscription, providing them an opportunity to review their ongoing commitments with Carousify. If you wish to cancel your subscription, you can do it before the renewal to avoid hassles and to avoid getting charged for the next billing cycle.

Non-cancellation of your account before renewal will further result in automatic payment, which can only be refunded within 48 hours of payment. So, in the case of auto-payments, make sure you notify us on time to support@carousify.com.

6. Free Trials & Lifetime Deals

Carousify may offer free trials or lifetime deals for our services. By using these offers, you agree to the following:

1. Trial Period: If you join a free trial, you can use our services for a limited time. After the trial ends, your subscription will auto-renew to our paid plans.
2. Cancellation Rights: We can cancel or end any free trial or lifetime deal at any time, without notice. We work hard to provide good services, but we cannot promise that these offers will always be available.
3. Lifetime Deals: Accounts created under lifetime deals follow the same rules as these Terms. We can suspend or close any lifetime deal account if we believe it is being misused, violates our policies, or is for any other reason, such as fair usage policy, automation, etc.
4. Payment Method Requirement: To access any free trial or lifetime deal, you must provide a valid payment method. This payment method will also be used for auto-renewal of your subscription once the trial period ends or if you choose to upgrade your plan.
5. Ending Services: If we can no longer provide our services or decide to stop our operations for any reason, we can close our platform at any time, even if you’re on a Lifetime plan. However, we will give you three months notice to allow you to move your data to another platform.
6. Changing Features: We can change, add, or remove features in our free trials and lifetime deals whenever we want. This means we might introduce new features or take away some existing ones without prior notice.
7. Liability Disclaimer: Carousify is not responsible for any losses or damages if we cancel free trials, lifetime deals, or stop our services. You are responsible for your own account and data during this time. Please make sure you back up your data before we stop our services.

7. Intellectual Property Rights

All content, features, and functionality on Carousify.com, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, and software, are the exclusive property of Carousify or its licensors and are protected by applicable copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our website without our prior written consent. Any unauthorised use of our Services, its content, etc., can terminate your rights to use our Services immediately.

8. Privacy Policy

Your privacy is important to us. Our Privacy Policy outlines how we collect, use, and protect your personal information when you use our website and services. By using Carousify.com, you consent to the collection and use of your information in accordance with our Privacy Policy.

9. Limitation of Liability

Carousify.com, along with its owners, directors, investors, employees, agents, affiliate partners, and suppliers, is not responsible for any direct, indirect, incidental, consequential, or exemplary damages resulting from your use of our website and its Services.

We are also not liable for any damages if the generated content/carousels or any of our services have harmed your social media profiles or presence. Some social media providers may even ban you for using automated services; therefore, if your account faces restrictions or bans, you are solely responsible for it.

Also, if you infringe LinkedIn’s Terms of Service (available at https://www.linkedin.com/legal/user-agreement) or any other social media platform’s policies while using our services, you bear full responsibility for any consequences that arise from such infringements. Carousify.com strongly advises users to familiarise themselves with the terms and conditions of the social media platforms they engage with to avoid any potential violations. We can also reserve the right to close your Carousify account if we recognise such activities to preserve the security of other users.

10. Termination

We reserve the right to terminate or suspend your account at any time, without notice, if we believe you have violated these Terms. We can even terminate/cease your account if you don’t qualify under applicable law, to access and use the Services or for any legal/regulatory reasons.

We also reserve the right to take legal action against you for violating these Terms.

11. Changes to Terms

We may update these Terms from time to time. The revised terms will be posted on this same page of our website with a new effective date. These changes apply immediately upon being published on our platform.

Your continued use of our website or its services after the update of these terms signifies your acceptance of the new Terms.

12. Governing Law

These Terms are governed by the laws of India. Any disputes related to these Terms, services, or content will be resolved in the courts of New Delhi, India, without giving effect to any choice or conflict of law provision or rule.

THE SERVICES PROVIDED BY CAROUSIFY ARE OFFERED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CAROUSIFY DISCLAIMS ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CAROUSIFY DOES NOT GUARANTEE THAT THE SERVICES WILL BE AVAILABLE AT ALL TIMES, SECURE, OR FREE FROM ERRORS. WE DO NOT WARRANT THAT THE INFORMATION OBTAINED THROUGH OUR SERVICES AND THE USE OF AI ON OUR WEBSITE WILL BE ACCURATE OR RELIABLE.

ANY CONTENT, EVEN IF IT IS RELATED TO CREATING CAROUSELS / POSITING CONTENT ON PLATFORMS / USING AI THROUGH OUR PLATFORM OR SERVICES IS DONE AT YOUR OWN RISK. YOU WILL BE RESPONSIBLE FOR ANY DAMAGES THAT ARISE DUE TO THE USE OF THOSE THINGS.

IN NO EVENT SHALL CAROUSIFY BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICES OR YOUR INABILITY TO USE THEM.
